Recovering payment on undelivered item.

At the end of Jan I ordered some lighting from an Italian supplier (who appeared reliable and were actually recommended by my local lighting shop). The goods (about £500) were shown as in stock and so my card was debited (Visa).

 

I received an email 2 weeks later apologising for the delay but assuring me the items would arrive soon, another a week or so after that and a last communication in early March saying the same. After that nothing.

 

I've sent several emails, a fax and now a recorded delivery letter asking for a refund of my money and cancellation of the order. So far no response (although the letter was only sent today). I even got the letters and emails translated into Italian via Babelfish!

 

Anyone suggest what I do next if I fail to make progress? I'll have a chat with Visa but suspect it may be too late to try to recoup the payment.

Bruce, you have up to 120 days to make a claim against your card company, so give them a call.

 

If you have a Visa credit card, you're probably protected by Section 75 of the CCA 1974. If it's a Visa debit card, there's a second system called chargeback that your card issuer will have signed up to. Found this for you (hope RD is ok with the link) from Which:

Bruce, you've made enough communication with the company and haven't received a reply for 6 weeks. I suggest you ring your credit card co and tell them you're the victim of fraud and wish to receive a full refund immediately. They will then send you a form to complete to confirm you've not received the goods.

 

You shouldn't have a problem.

I phoned the card supplier (it was actually Amex) and they could  not have been more helpful.

 

Nice to know you have that back-up, I'd never had cause to use it before.
