your example is different than the situation I am in and what I was trying to explain. To correct your example to more align with my situation:

I want to buy a VW and I go on the forums to see the features and there are existing drivers telling me what features it has etc and they all rave about the ipod digital interface.

I go to my local VW dealer and purchased said model and drive it off the lot. Then I find out that it doesn't have the feature, that I need to bring my new car back to get it upgraded.

When Naim sells the exact model with a differing feature set, it confuses the market and messes up people's expectation.

If they release Uniti MKII and added the new fatures, and I can see that my "new in box" Unit is MKI, then I know what to expect. I am not asking for UnitiQue features in my Uniti.. I am asking for the SAME feature as a post Feb 2010 shipping Uniti!

There's two different issues here ...

First off there's if a product is later updated via firmware - should Naim always have to provide those features (for free)? The product still works as described when you purchased it. This is where I was commenting on.

Second is a dealer selling older stock as new (Joe's situation). In this case the dealer is responsible and all "sold as new" stock should have the features as advertised on the website: maybe Naim should be putting a sticker on the outside of the box with the firmware version on - a lot of other manufacturers do so dealers / customers can check it has the latest firmware version. I really think joe your issue is with the DEALER not with NAIM! I'm not sure if you are in the UK (and I'm not a lawyer) but being missold in this way should be covered under sale of goods act - you bought in good faith a new NaimUniti and can reasonably expect it to be as currently shipped / advertised by Naim. Unless of course the dealer made it clear to you it was New Old Stock.

Its common practice (in some markets) for two versions of the same product to be named the same ... but for features on the later one to vary. Back to my Golf car analogy - there are various versions of the radio that fit into a Golf: some support iPod via 3.5mm analogue jack, others support full iPod control. Go into a dealer though and ask about the new Golf they have in stock and it will take a lot of asking to find out if the iPod connection is basic analogue jack cable or fully integrated. I'm not saying it's right, but it is a common practice.

I think we agree that at least there should be a way to tell before purchase which version I would be getting.

At the end of the day this seems to be a huge amount of discussion for a simple resolution ... contact your dealer and ask them to simply update the unit with the latest firmware.

Yes, check the 'Factory Settings' which gives a wealth of information, including the unit's latest firmware.

jtktam is obviously not happy with his purchase. My dealer upgraded my Uniti purchase with the latest update before shipping in April.
The dealer has an obligation to disclose the exact nature of the product. Naim gear is far from cheap and i for one would also be pissed.
Doesn't the dealer have an obligation for full disclosure and customer service.

I would want a new fully loaded Uniti on my doorstep if i paid fulll retail , or a discount for old stock ....simple as that.
