Speeding On The M4 In Wiltshire !!!!
Posted by: Berlin Fritz on 13 April 2005
A 19 year old lad has just been jailed for two years at Swindon County Court for speeding his ford Anglia car (downhill with a strong wind behind him) at 73MPH. A local Town Elder Mr Micky Parrey was quoted as saying "These kids really must learn somehow, I know it's his first offence and that he's studying to be a postman, but the Law is the Law". Upon being led to the cell's to begin his sentence the prisoner commented "Yeah my Dad's always been a bit of a stickler for righteousness and fairplay, God bless his cotton socks"

Under english law the failure to serve an NIP in such circumstances would be fatal to the case.
That issue about serving the NIP also applies in Scotland. In this case I think there might be some technicality about how the NIP was served so it'll be interesting to see if further details become available. The case got to court and it wasn't thrown out immediately which I'd have expected would have happened had it been straightforward.
The driver did dispute that he was driving the car at the time, which is why the testimony of the operator was important.

Andy,
Put yer clog down. We don't want you falling asleep at the wheel. At a steady 90 to 95 on an empty motorway you'll get there quicker and safer.
I know that and you know that. Think of a tree falling in a forest...
Sod the witch-hunts!

Yes, but what if it fell on the motorway?

well, if you were doing 90 it would fall behind you, 70 and it would fall in front of you and you'd crash and burn.

The original charge was dangerous driving and the sheriff denied the crown from bringing in an alternative charge of "culpable and reckless conduct".
It turns out the sheriff denied that charge because there was no evidence that the drivers actions presented a danger.

I wonder sometimes (barring exceptional circumstances) why they need to be chased at all ?

I think it's important to understand that in the interim period (before road charges come in) Gordon's fiscal cycles have to be well oiled and ready, so the following Legislation will ensure continuous revinue for the government. If caught in a log-jam on the M6 in Wiltshire in future, being stationary (irrespective of cause)for longer than five minutes will constitute illegal parking and you will be clamped by our new Community Safety Officers. The standard £850 fine will vary depending on arrogance, verbal retaliation, and
general negativity of the motorists involved.
