”95% of the people who died in the U.K. last year, had eaten tomatoes”

Not perfectly true. Some people are average and only the remaining part of the population are either above or below average, which means both groups a smaller than 50%.

Ah now I think we should be more precise - 50% of the population more intelligent than the median (the middle value), not the average! Though that depends on the distribution of values above and below the average (eg, median earnings are normally quite a bit lower than average, since there is a greater variation above the middle than below)
