US F1 fan to sue

Posted by: Deane F on 20 June 2005

Came across this on Google news. It'll be interesting to see how far it gets.

I think that the formation lap by the Michelin tyred teams was driven to avoid exposing the teams to such a liability but perhaps I am too cynical. I do wonder why they went out at all if they were not intending to race.

---excerpt from article---- "Before a frustrated Formula One fan from Colorado Springs left Indianapolis yesterday, he hired a lawyer to file a class-action lawsuit against nearly everyone connected to Sunday's ill-fated United States Grand Prix.

Larry Bowers, who had paid more than $500 for five tickets to the race, sued the Fédération Internationale de l'Automobile (F.I.A.); Formula One Management, which oversees the finances of the series; the tiremaker Michelin; and the Indianapolis Motor Speedway, said his lawyer, William Bock III.

The lawsuit, which was filed with the United States District Court in Indianapolis, contended that Sunday's event did not "constitute a true grand prix race under F.I.A. and Formula One rules in that the race was started with an insufficient number of participants."

or perhaps not, that seems to be the reason being circulated for what they did.

I'm 100% certain that all the teams lined up for the parade lap in order to reduce the likelyhood of litigation. Cars lining up for the parade lap are regarded as having started the race, which gets round the insufficient participants issue.

There are times when I envy the US jurisdiction for the availability of the courts there for civil disputes. In New Zealand there is much that is not justiciable because of the Accident Compensation Corporation scheme.

Of course, taking F1 on in the courts will be like taking on the tobacco companies. They will have better lawyers (teams of them) and endless amounts of money to throw at filing appeals etc.

I hear where your coming from Our Deane, but I sense this one will be won by the punter, and quickly over and done with, and everybody's happy again, and back to playing wiv motors, innit Cool

Fritz

Do you mean that this'll be quickly settled for the sake of public relations?

Not sure - I tend to think that the legal buck will be passed with great speed until somebody is left holding it. Nobody will take legal responsibility. The Indy track operators are certainly deciding who to sue as well as the punter who has already filed.

I mean't that they'll sort out the disgruntled fans asap (out of court settlement, bonus tickets or something), as they were pissed off enough to chuck beer cans etc onto the track etc, they'll possibly organise future protests (around the world) with boycotts, then without their entrance dosh, etc, etc, the so-called sport won't have any income anyway, besides fags, jonnies & TV.

Fritz Von I reckon the tyre case will go on for eternity though: Big Grin

Maybe should be renamed FU for all the obvious reasons.
Not sure what it stands for in World Sport today but won't make my top ten.

Is there really? Well, it's not my birthday this weekend if that's what you mean.

There is some professionalism happening down the road from me sometime this weekend though. It will involve head-stomping and men encircling other men's waists until they both fall on each other. For money.

And all right thinking people will deplore the F1 circus for the fiasco at Indy. But I guaran-damned-tee (as Americans say) that 95% of those people watch the next race.

Publicity......

I think the disgruntled F1 fan should really sue his parents, because it's their fault he was born and eventually wound up at Indy in the first place.
And why not sue the mothers and fathers of all those involved in Formula One since its inception...

When all else fails "Blame Canada!!!"
