Arab guilty of rape after consensual sex with Jew



'A Palestinian man has been convicted of rape after having consensual sex with a woman who had believed him to be a fellow Jew.

Sabbar Kashur, 30, was sentenced to 18 months in prison on Monday after the court ruled that he was guilty of rape by deception. According to the complaint filed by the woman with the Jerusalem district court, the two met in downtown Jerusalem in September 2008 where Kashur, an Arab from East Jerusalem, introduced himself as a Jewish bachelor seeking a serious relationship. The two then had consensual sex in a nearby building before Kashur left.

When she later found out that he was not Jewish but an Arab, she filed a criminal complaint for rape and indecent assault.

Although Kashur was initially charged with rape and indecent assault, this was changed to a charge of rape by deception as part of a plea bargain arrangement.

Handing down the verdict, Tzvi Segal, one of three judges on the case, acknowledged that sex had been consensual but said that although not "a classical rape by force," the woman would not have consented if she had not believed Kashur was Jewish.

The sex therefore was obtained under false pretences, the judges said. "If she hadn't thought the accused was a Jewish bachelor interested in a serious romantic relationship, she would not have cooperated," they added.

The court ruled that Kashur should receive a jail term and rejected the option of a six-month community service order. He was said to be seeking to appeal.

Segal said: "The court is obliged to protect the public interest from sophisticated, smooth-tongued criminals who can deceive innocent victims at an unbearable price – the sanctity of their bodies and souls. When the very basis of trust between human beings drops, especially when the matters at hand are so intimate, sensitive and fateful, the court is required to stand firmly at the side of the victims – actual and potential – to protect their wellbeing. Otherwise, they will be used, manipulated and misled, while paying only a tolerable and symbolic price."

Gideon Levy, a liberal Israeli commentator, was quoted as saying: "I would like to raise only one question with the judge. What if this guy had been a Jew who pretended to be a Muslim and had sex with a Muslim woman?

"Would he have been convicted of rape? The answer is: of course not."

Arabs constitute about 20% of Israel's population, but relationships between Jews and Arabs are rare. There are few mixed neighbourhoods or towns, and Arabs suffer routine discrimination.

Israeli MPs are considering a law requiring prospective Israeli citizens to declare loyalty to Israel as a "Jewish, democratic state". Many Arabs would balk at swearing allegiance to a state which they see as explicitly excluding or marginalising them.

Dan Meridor, a deputy prime minister in Binyamin Netanyahu's government, is opposed to the proposal. "Why does every bill need the word 'Jewish' in it – to show the Arab citizens that it doesn't belong to them? Then we're all shocked when they radicalise their stance.

"The majority doesn't need to remind the minority that it is in fact a minority all the time," he added'.

No justice there by any standard, Israel or the Bigg Market.

David Scott, I owe you an apology, about the thing about you saying that too often things are said too lightly or sloppily in discussions about Israel. I wasn't saying anything about what you were saying as being racist, and if I did I apologize. I see your point and other posters points. Assumedly, this will be thrown out on appeal.
I must confess, as a member of the 'tribe' I react too much sometimes. Israel, and Jews should not be above the law. I'm not trying to hijack the thread, but growing up in Canada it's hard not being oversensitive at times. I try to keep my religion private, but often my religion is thrown in my face. I could be buying a bike or a stereo and all of a sudden the salesman feels he needs to mention my religion based on the length of my nose or my last name. It's just over the top, at times. Sometimes, from my point of view, commentary about Jews and Israel just seems disproportionate to what's going on. Not that Israel should be above criticism or the law, just seems too much at times. And I tend to react defensively. Sometimes, it's my perception that the English press, and English Human Rights groups, more than any country, concentrates too much on what Israel does. This is the topic of another thread, but Jews have lived continuously in "Palestine" since day one. We have every right to be there, and the Palestinians have the right to their own country. Not sure if it should be half of Israel and/or half of Jerusalem. In any event, I apologize for reacting and of accusing you of anything.

Am very empathic about the unfair comments that might be triggered by your last name. Still, consider yourself lucky because you are not automatically assumed to carry a bomb and your rectum doesn't get routinely probed in American airports because of your last name. I'd very much prefer a comment about my nose as long as the officer's finger stays outside my orifice. You have a walk in the park compared to what we have to go through these days.

Really no need to apologise. I didn't feel you were accusing me of racism - perhaps of an anti Israel bias, but I understand why Jewish people are sensitive about that. This:

No sympathy whatsoever for that silly woman who never took any time to know the person she was having a relationship with and later complains to the police of being deceived.

As for the judge, if you will excuse me, I think that he is a total idiot. Regardless to what the letter of the law says and even if he could not have dismissed this humiliating case altogether, he should have just passed a sentence more appropriate to the offense, something like a community service. By imposing a prison term he comes across as a judge who clearly discriminates against Arabs.

I am sure that Dudu is getting hell from his Palestinian wife and her family and I see no reason for him to sit in an Israeli jail on top of it.

There are numerous cases of Israeli women dating Arab men, sometimes marrying them and moving to live in their communities. It is almost unheard of the opposite, Palestinian women having relationships with Israeli men. My only sad conclusion is that Israeli men are just not attractive enough.

Haim, always nice to see your reasonable approach to matters. Smile

David, thank God I never found myself in the position I described. I was referring to a US legislation which was passed about 6 months back which stated that citizens of countries x,y,z etc would be routinely subjected to "cavity searches" at American airports. I don't know how consistently the searches are being carried out, but a lot of dismay was expressed in the Arabic media.

Haim's comments reminded me of an Adam Sandler movie from 2008. "Don't Mess With The Zohan" was a funny take at Palestinian Israeli romance. The movie was funny, neutral and moral. For those interested in a light-hearted comedy and a fresh take at the Palestinian Israeli conflict, you'd enjoy the movie.
